Financing Statements
The purpose of this information is to better inform the general public of procedural matters. Nothing contained herein is intended to advise anyone as to legal remedies for a particular circumstance. Circuit Court Clerks and their Deputy Clerks cannot render legal advice.
The Office of the Clerk of Circuit Court may, upon presentation of the proper form and filing fee, record and index a financing statement upon the records of this jurisdiction.
The filing fee for financing statements is $20.00 per filing. There is also a charge of $20.00 for information requests related to financing statements, which does not include additional copy fees. A copy request for a "specific instrument" may be submitted in writing. The copy request must include the book and page number, as well as the proper filing fee. Copies are $.50 per page and $2 additional for each certification. To ensure proper return of the receipt, validated papers and/or copies, please provide a self-addressed, stamped envelope. Payment may be made by check, cash or money order.
Please note that Roanoke County, Roanoke City and City of Salem are separate jurisdictions. Verify before filing.
NOTICE: EFFECTIVE JULY 1, 2001
The 2000 session of the Virginia General Assembly passed House Bill 1204. This updates Article 9 (Secured Transactions) of the Uniform Commercial Code, which was last revised in 1972 and adopted by every state. Article 9 provides a statutory framework for transactions that involve the granting of credit secured by personal property.
Filings will be with State Corporation Commission only; local filing, other than fixture filings, will be abolished.
The new Article 9 generally provides for the filing of a financing statement in the state where the debtor is incorporated. The scope of Article 9 is expanded to include kinds of property such as deposit accounts, health care receivables and commercial tort claims, that were excluded in original Article 9. The location of the debtor rather than the location of the collateral will determine where a security interest perfects. The fee for filing a financing statement is increased from $10.00 to $20.00. The bill has an effective date of July 1, 2001. Article 9 is the product of the National Conference of Commissioners of Uniform State Laws.
The Circuit Court Clerk's Office of Roanoke County also requires the use of the tax map reference number on these filings as provided for in the Code of Virginia §17.1-252. This number may be obtained from the office of the Real Estate Assessor at (540) 772-2035 ext. 0 during regular business hours.
